Terms of Use (Local Apps)

These Terms of Use ("Terms") govern your use of the mobile application (the "App") developed by ArnoHealth S.L. ("onmedic", "we", "us", "our"). By installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a single mobile device owned or controlled by you, strictly for your personal, non-commercial use, in accordance with these Terms and any rules or policies applied by the app store from which you downloaded the App (e.g., Apple App Store, Google Play).

2. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to its design, structure, code, graphics, user interface, and algorithms, are and will remain the exclusive property of ArnoHealth S.L. and its licensors. The App is protected by copyright, trademark, and other laws of Spain, the European Union, and foreign countries. You may not copy, modify, decompile, reverse engineer, or create derivative works based on the App.

3. No Medical Advice

IMPORTANT DISCLAIMER: If this App presents, processes, or visualizes health, sports, physiological, or medical metrics, it does so strictly for informational, educational, or personal tracking purposes. The App does not provide medical advice, diagnosis, treatment, or clinical decisions.

The App is not a substitute for professional medical advice, evaluation, or care. Always consult with a qualified healthcare professional before starting any physical exercise program, making changes to your health routines, or if you have any questions regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information presented in or obtained through the App.

4. Local Operation and Data

This App operates entirely locally on your mobile device. Your data, inputs, and measurements are stored directly on your device using local storage or databases and are not transmitted to or hosted on our remote servers. Because we do not store your data, you are solely responsible for backing up your device and your data. We cannot retrieve or restore any data if you delete the App, lose, or damage your device.

5. Limitation of Liability

To the maximum extent permitted by applicable law, the App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. ArnoHealth S.L. does not warrant that the App will meet your requirements or that its operation will be uninterrupted or error-free.

In no event shall ArnoHealth S.L., its directors, employees, or partners be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this App, even if advised of the possibility of such damage.

6. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of Spain. You agree to submit to the exclusive jurisdiction of the competent courts of Barcelona, Spain, to resolve any legal matter arising from these Terms, unless mandatory consumer protection regulations dictate otherwise.

7. Changes to these Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make updates, we will change the "Last updated" date at the top of these Terms. Your continued use of the App following any changes constitutes acceptance of the new Terms.
