Terms of Use (Online & Account Apps)

These Terms of Use ("Terms") govern your use of the mobile application and associated cloud services (the "App") developed by ArnoHealth S.L. ("onmedic", "we", "us", "our"). By creating an account, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. User Accounts and Authentication

To access certain features of the App, you may be required to register and create an account. You may register manually (with an email and password) or use third-party authentication services (such as Google Sign-In or Apple Sign-In).

You are responsible for safeguarding your credentials and for all activities that occur under your account. You agree to notify us immediately at info@onmedic.com upon becoming aware of any breach of security or unauthorized use of your account.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on mobile devices owned or controlled by you, strictly for your personal, non-commercial use, in accordance with these Terms.

3. No Medical Advice

IMPORTANT DISCLAIMER: If this App presents, processes, or visualizes health, sports, physiological, or medical metrics, it does so strictly for informational, educational, or personal tracking purposes. The App does not provide medical advice, diagnosis, treatment, or clinical decisions.

The App is not a substitute for professional medical advice, evaluation, or care. Always consult with a qualified healthcare professional before starting any physical exercise program, making changes to your health routines, or if you have any questions regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of information presented in or obtained through the App.

4. Cloud Synchronization and Service Usage

The App transmits data to our secure servers to enable core functionalities (such as backing up settings, syncing workout or health history across multiple devices, or processing analytics). You agree not to misuse our APIs, servers, or networks, nor attempt to gain unauthorized access to any part of the service. We reserve the right to temporarily suspend or permanently terminate your account if you violate these rules.

5. Intellectual Property

All rights, title, and interest in and to the App and its cloud services, including but not limited to its design, structure, code, graphics, user interface, and algorithms, are and will remain the exclusive property of ArnoHealth S.L. and its licensors. You may not copy, modify, decompile, reverse engineer, or create derivative works based on the App or its service APIs.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the App and its services are provided on an "as is" and "as available" basis, without warranties of any kind. ArnoHealth S.L. does not warrant that the App will meet your requirements or that its operation will be uninterrupted, secure, or error-free.

In no event shall ArnoHealth S.L., its directors, employees, or partners be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, loss of use, data, or profits; or business interruption) arising in any way out of the use of this App or its cloud services, even if advised of the possibility of such damage.

7. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of Spain. You agree to submit to the exclusive jurisdiction of the competent courts of Barcelona, Spain, to resolve any legal matter arising from these Terms, unless mandatory consumer protection regulations dictate otherwise.

8. Changes to these Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make updates, we will change the "Last updated" date at the top of these Terms. Your continued use of the App following any changes constitutes acceptance of the new Terms.
